It's scary from a songwriter's point-of-view that you can't write a song without that fear at the back of your mind that you might be sued for unintentionally copying someone else's work...

...considering it sounds like a relatively simple melody, the lawsuit from Petty's camp leaves a bad taste in my mouth.

There's also the little thing about the vocal melody on the chorus being 100% exactly the same.  Do you really not hear that??

I assume the chorus thing you are talking about is the "Stay with me, cause you're all I need" matching "Stand my ground and I won't back down?" The syncopation is similar (but different tempos) and the actual notes are at best a 50% match. I feel like you could find that level of match with any song to at least one other song. Unless you can prove intention, I just don't think you should be able to make an IP claim. But this is how corporate thugs win, even if they know they don't have the law on their side, they know they can win a financial war of attrition. It just really gets my goat.

I don't really have a position on the legal issue either way, but the songs are undoubtedly similar.

Another mash-up that proves beyond a shadow of a doubt that if you heavily manipulate both songs, they sound sort of similar. Though I think putting the vocals on top of each other like this shows just how not similar they are in structure.
