I believe that a few 2009 eligible films are now available on Netflix instant,

The Girlfriend Experience
Lymelife
Treeless Mountain

There may be more, but those are the three I can remember off hand.

Fired Up!
Paul Blart: Mall Cop
Surveillance
Il Divo
Silent Light

Probably others as well, likely documentaries.

If it has duder's approval, I'm counting it as a 2009 film.

Wondering if Ballast, Dear Zachary, and that film that 1SO thought I was not good enough to review are Filmspot eligible.
No, no, and I'm not sure what you're talking about.
Didn't Ballast have a stupidly limited release? Isn't it basically premiering on DVD? We need new rules, dammit!

I'm in favor.

Of new rules, or of Ballast being eligible? Because if it's eligible it's one of the instant films I will be watching sooner rather than later.

Ballast pretty much only played at a handful of film festivals so I think it should be considered a 2009 film.

Define "pretty much".  I believe it opened at the Music Box in Chicago on October 31, 2008; at the Sundance Kabuki in San Francisco on October 17, 2008; in Boston on October 31, 2008...

That said, I'm personally still in favor of changing the rules.  Just need someone to propose a standard.

We go by the (limited) release date on films that don't get wide releases on IMDB and if a film doesn't have that we go by its DVD release date (such is the case with ballast.

That's how I've always done it.

I'm hoping to pull another upset this year. A Serious Man over Up or Inglourious or whatever else has the spotlight. Not the Serious Man is necessarily better than IB, but it would make me happy to shake things up two years running.

I don't know whether to laugh or cry. Can we just pretend that film never existed?
